This Custom Service Agreement (“Agreement”) sets forth the terms and conditions under which you (“User,” “you,” or “your”) may access and use the FK Online platform, operated by FK Online (“Company,” “we,” “us,” or “our”). By purchasing, accessing, or using our services, you agree to the following:

1. Intellectual Property 

1.1 All tutorials, videos, choreographies, training materials, guides, images, and written content (“Content”) provided on the FK Online platform are the exclusive intellectual property of FK Online, Alëna Kuzmina, and Dmitry Fedotov.

1.2 The Content is protected under copyright, trademark, and intellectual property laws.

1.3 Users are strictly prohibited from copying, reproducing, distributing, publishing, modifying, displaying, transmitting, or creating derivative works from the Content without prior written consent from the Company.

2. Personal Use Only 

2.1 The Content is provided for your personal, non-commercial use only.

2.2 You may not share, sell, sublicense, or otherwise provide access to any Content to third parties.

2.3 You may not allow others to use your account, username, or password. Each account is intended for a single individual.

2.4 Any attempt to share login details, distribute Content, or make it publicly available constitutes a material breach of this Agreement.

3. Digital Format & Access 

3.1 All Content is provided in digital format only. No physical products are shipped.

3.2 Access to the platform is granted through a subscription or purchase plan and remains valid only during the active subscription period.

3.3 Access to course materials is granted for the duration of your active subscription. If you cancel, access will be revoked at the end of your billing period. 

3.4 The Company reserves the right to update, modify, or remove Content at any time without prior notice.

4. Sales, Refunds & Services 

4.1 Due to the nature of the Content, all sales are final, and refunds are not available. 

4.2 Live coaching sessions are scheduled monthly. Replays will be made available if you cannot attend live.

4.3 Personalized feedback and homework reviews are available on demand, but response times may vary depending on workload. 

5. Prohibited Conduct 

You agree not to:

• Share, sell, or transfer your login credentials;

• Download, record, or distribute Content outside of the platform;

• Use the Content for teaching, coaching, or training others without written permission;

• Circumvent or attempt to bypass security or access controls on the platform.

6. Termination 

6.1 Violation of any terms in this Agreement may result in immediate termination of your account and access to the platform, without refund.

6.2 The Company reserves the right to pursue legal action for unauthorized use, reproduction, or distribution of Content.

7. Disclaimers 

7.1 The Company does not guarantee any specific fitness results or performance improvements. Results may vary depending on individual effort, health, and other factors.

7.2 Participation in physical activity carries inherent risks. By using the Content, you acknowledge that you are voluntarily engaging in exercise at your own risk.

7.3 Consult your physician before beginning any new training program.

8. Limitation of Liability 

To the maximum extent permitted by law, the Company shall not be liable for any injuries, damages, or losses arising from your use of the Content or the platform. Your sole remedy for dissatisfaction with the service is to discontinue use.

9. Governing Law 

This Agreement shall be governed by and construed in accordance with the laws of Belgium, without regard to conflict-of-law principles.

10. Acceptance of Terms 

By purchasing, accessing, or using the FK Online platform, you confirm that you have read, understood, and agreed to be bound by this Agreement.
